Terms of Sale
By purchasing online, the customer agrees to be bound by this purchase agreement and accepts its terms and conditions. This Purchase Agreement is a legal contract between the Customer and www.theantiquehardwaresupply.com. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the Site. (References to "you" or "your" shall relate to the Customer; references to "www.theantiquehardwaresupply.com" or shall relate to www.theantiquehardwaresupply.com.) The terms and conditions of this Purchase Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question. This Purchase Agreement constitutes the entire agreement between the Customer and www.theantiquehardwaresupply.com relating to the purchase or sale of goods or services on the Site. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the Site in a writing signed by an authorized agent of www.theantiquehardwaresupply.com. Electronic records (including signatures), that are otherwise valid, shall be accepted under the Purchase Agreement.
The Customer consents to receiving electronic records, which may be provided via a web browser or e-mail application connected to the Internet; consumers may withdraw consent to receiving electronic records or have the record provided in non-electronic form by contacting www.theantiquehardwaresupply.com at the address provided below. In the event of any conflict between the terms and conditions stated on your purchase order and this Purchase Agreement or any terms and conditions on our invoice, you agree that the provisions of this Purchase Agreement and our invoice shall control.
Governing Law
This agreement and any sales hereunder shall be governed by the laws of the state of Michigan, without regard to conflicts of laws rules. The customer consents to the jurisdiction of the federal or state courts located in Wayne County, Michigan for purposes of any suit, action or proceeding arising out of this Purchase Agreement.
Title
Risk of Loss Title to goods herein being purchased is retained by the seller (www.theantiquehardwaresupply.com) until goods are paid for by the purchaser and at that time title passes to the purchaser. Loss or damage that occurs during shipping by a carrier selected by www.theantiquehardwaresupply.com is the responsibility of www.theantiquehardwaresupply.com. Loss or damage that occurs during shipping by a carrier selected by the Customer is the responsibility of the Customer.
General Legal Disclaimer
www.theantiquehardwaresupply.com hereby expressly disclaims all warranties either expressed or implied, including without limitation, any warranty of merchantability or fitness for a particular purpose. This disclaimer by www.theantiquehardwaresupply.com in no way affects the terms of the manufacturers warranty, if any.
www.theantiquehardwaresupply.com's Limited Warranty
Effective June 20, 2017, some products we sell will be covered by the listed limited warranty. This warranty is available on some products and the availability is listed on the product pages. The warranty it is limited to the metal and mechanical parts and excludes ceramic, glass and crystal parts and components. The warranty period varies from one to five years depending upon the product. The limited warranty is available only for those products that show a limited warranty available on the product pages. The limited warranty covers defects in material and workmanship and the warranty is limited to metal and mechanical parts. This warranty excludes damage from a) Accident, act of nature, abuse, misuse, neglect, unauthorized product repairs, modification or failure to follow instructions supplied with the product b) Any shipment of the product (claim must be presented to the carrier) c) Items subject to wear from normal usage (scratches, scuff marks, kick plates, ceramics, glass etc.) d) Use of the products outside of the U.S.A. e) Use in industrial, commercial and/or professional applications f) Any installation or removal charges resulting from product failure. If during the applicable warranty period from the date of original consumer purchase your www.theantiquehardwaresupply.com product is found to be defective, www.theantiquehardwaresupply.com will repair, or at its option, replace with a new or used equivalent model, such defective product without charge for parts or labor.
Pricing and Information Disclaimer
All pricing is subject to change. For all prices, products and offers, www.theantiquehardwaresupply.com reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances. If an item has been discontinued by the manufacturer, www.theantiquehardwaresupply.com reserves the right to ship a replacement item without notice to the consumer, provided there is no price difference, and the specifications on the replacement item is equal to or greater than the original item ordered. There are no guarantees, express or implied, that finishes, colors, or other qualities of product will be consistent from one shipment to the next. For all items sold, measurements are approximate in all cases. While www.theantiquehardwaresupply.com uses reasonable efforts to include accurate and up-to-date information on the Website, www.theantiquehardwaresupply.com makes no warranties or representations as to the Site's accuracy. www.theantiquehardwaresupply.com assumes no liability or responsibility for any errors or omissions in the content on the Website.
Limitation of Liability
www.theantiquehardwaresupply.com will not be liable for lost profits, loss of business or other consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein. www.theantiquehardwaresupply.com will not be liable for products or services not being available for use or for lost time, wages or materials. Customer agrees that for any liability related to the purchase of products or services, www.theantiquehardwaresupply.com is not liable or responsible for any amount of damages above the aggregate dollar amount paid by the customer for the purchase(s) under this agreement.
International Credit Cards/Freight Forwarding
At www.theantiquehardwaresupply.com, international credit cards are not accepted. www.theantiquehardwaresupply.com does not ship to any Freight Forwarding facility for the purpose of exporting goods and circumventing International shipping costs or duty nor will we accept and substitute International Shipping Addresses once the order is placed using a domestic address.
To address the prevalence of fraud in international shipping, www.theantiquehardwaresupply.com fulfills orders only when the destination corresponds to the country linked with the credit card and does not trigger any fraud alerts in our credit card system. If our system identifies your order as potentially fraudulent, www.theantiquehardwaresupply.com retains the right to cancel the order at any point. Customers using an international credit card may ship domestically but the payment must be resubmitted by money order. Otherwise these orders are refunded and subject to a thirty-five percent restocking fee to protect the company from fraudulent orders.
Fraud Prevention
To protect both our customers and our business, we have implemented measures to address potential fraudulent activity:-
Medium-Risk Fraud Orders: If an order is flagged by our system as medium-risk for fraud, it will be placed on hold. Our Customer Service team will attempt to contact the individual who placed the order by phone to confirm it was placed intentionally. The customer will be asked to verify the billing address and provide the last four digits of the credit card used by responding to our official email address. This is a precaution to safeguard against unauthorized purchases and fraudulent transactions.

High-Risk Fraud Orders: Orders flagged as high-risk will be canceled immediately and will not be fulfilled.
By placing an order on our website, customers agree to comply with this policy. If we are unable to reach the customer via phone or confirm the required information for medium-risk orders, the order will not be fulfilled.
Insufficient Funds/Disputed Payments/Held Payments
www.theantiquehardwaresupply.com will assess a $75.00 fee to any account whose payment is NSF (i.e. bounced check), returned, held or otherwise put into dispute, charge reversal or any credit card or issuing bank that demands a written response. Accounts are billed for the interest on that amount compounded daily. The interest rate shall be the maximum allowable by law. This policy and fee applies to bounced payments, returned payments, insufficient funds, holds in escrow by credit card or other payment services, bankruptcy filings or any other form of payment reversal, removal or hold placed after the order has been placed or dispute where a written response is required in order to keep funds for shipped goods. These cases are referred to a collections agency reporting to all major credit reporting agencies including, but not limited to, Experian, Equifax and Trans Union.Order Charges, Changes & Cancellation
We understand that changes to your order may sometimes be necessary, and we will make every effort to accommodate change or cancellation requests. However, orders often begin processing immediately upon receipt. Therefore, we cannot guarantee that changes or cancellation will be possible, even if you contact us shortly after placing your order.
If an order can be canceled, a fee may apply. Cancellation fees typically range between 7% and 18% if the order has already entered production.To avoid potential fees, we recommend placing an order only when you are certain you would like to receive the items. Please reach out as soon as possible if you wish to request a cancellation. We will do our best to assist, though cancellation is not guaranteed, and any applicable fees will be deducted from your refund if the order can be halted.
Refused Orders
If a customer refuses delivery of a legitimate order, they will be responsible for the cost of both the initial shipping and return shipping. Additionally, an 18% cancellation fee will be applied to the total order amount.
In the event that a customer provides an inaccurate shipping address, resulting in the item being returned to Antique Hardware Supply and marked as "undeliverable," the customer assumes responsibility for both the shipping charges and an additional $15 fee for the reshipment of the order. Opting not to proceed with the order's reshipment will be regarded as a return, subject to applicable restocking fees.
Damaged, Incorrect and Defective Items Policy
It is the responsibility of the customer to carefully inspect merchandise and report damage or errors within 7 days of receipt. www.theantiquehardwaresupply.com accepts damaged or defective merchandise for exchange of same merchandise if reported within 7 days of your receipt of order. Return shipping of damaged or defective merchandise to www.theantiquehardwaresupply.com is solely the responsibility of the customer. Damaged merchandise is handled through www.theantiquehardwaresupply.com's Customer Service. Failure to follow instructions regarding the claim can nullify any reimbursement of fees or charges, and delay any exchange of merchandise by www.theantiquehardwaresupply.com.
Finishes of Antique Brass and Oil Rubbed Bronze are made by hand - one item at a time. Finishes may vary from order to order - but over time they will become more similar.
Contests
Occasionally AntiqueHardwareSupply will run contests and sweepstakes.
(i) To be eligible to participate in these contests, entrants must be U.S. residents.
(ii) Employees of AntiqueHardwareSupply, Facebook.com, and their affiliated companies, and advertising and promotion agencies and the immediate family members of each are ineligible. The term 'Immediate family" includes spouses, grandparents, parents, siblings, children and grandchildren.
(iii) No purchase is necessary. Void where prohibited.
(iv) To enter, simply fill out the online form outlining and advertising the sweepstakes or contest on Facebook.
(v) Contest beginning and ending dates are shown online on the contest forms. You may also request information by emailing [email protected].
(vi) Winners will be notified by the email supplied to us when filling out a contest form online. (vii) The email used on the contest form will be the email we use to contact the (1) winner.
(vii) To enter, log onto Facebook.com and fill out the contest form found on the AntiqueHardwareSupply page.
(viii) One (1) winner will be selected by random drawing among valid entries. Remaining entries will not carry over to the next drawing.
(ix) If a winner cannot be notified within fourteen (14) days, or does not timely sign and return the release and affidavit of eligibility, then the prize will be forfeited, and the prize will be awarded to an alternate winner randomly selected from among remaining valid entries.
(x) Each winner is responsible for paying all local, county, state and federal taxes on prizes based on the estimated retail value of the prizes as set forth in these rules. Each winner must complete and sign a Form W-9.
(xi) Only one prize will be awarded per household.
(xii) AntiqueHardwareSupply is not liable if the provider of any part of the prize fails to satisfy its obligation to furnish its portion of the prize.
(xiii) AntiqueHardwareSupply is not responsible for any liability arising directly or indirectly from the award or use of the prize.
(xiv) There will be no substitutions or cash alternatives for any prize except at the sole discretion of AntiqueHardwareSupply. AntiqueHardwareSupply has the right to substitute a prize of similar value. No transfer or assignment of prizes is allowed.
(xv) In claiming your prize, you acknowledge that AntiqueHardwareSupply has the right to publicize your name, character, likeness, photograph, voice and the fact that you are the winner for promotional purposes without financial remuneration,
(xvi) Odds of winning depend upon the number of valid entries received.
(xvii) For a list of prize winners, send a separate, self-addressed, stamped envelope to www.theantiquehardwaresupply.com at 29990 Beverly Road Romulus Michigan 48197 by at least 30 days after end of contest.
(xviii) This contest is subject to all applicable laws and regulations and is void where prohibited. AntiqueHardwareSupply and FACEBOOK accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession or use of any prize awarded hereunder.
(xix) AntiqueHardwareSupply cannot be held liable for any lost or stolen entries, prizes, or contest information. AntiqueHardwareSupply is not responsible for any computer or electronic malfunction, server unavailability, technological glitch, or human error relating to this contest and/or the use of short-code.
(xx) AntiqueHardwareSupply reserves the right to make rules and contest changes, and change the aforementioned contest dates.
(xxi) By entering this contest, each entrant waives any and all claims of liability against AntiqueHardwareSupply, Facebook.com, and their respective parents, affiliates, officers, directors, employees and agents, for any and all claims, loss, damage or injury which may occur as a result of entrant’s participation in this contest.
(xxii) Facebook, Inc., and www.facebook.com (collectively, “Facebook”) are not affiliated with AntiqueHardwareSupply nor this contest. This contest is in no way sponsored, endorsed, or administered by or associated with Facebook
Trade Advantage Program
Membership Requirements: Trade Advantage membership is subject to approval by Antique Hardware Supply. Antique Hardware Supply reserves the right to remove members from the program at its discretion, without prior warning. Currently, our Trade Advantage Program is only within the United States. Please note that using your Trade Advantage discount for personal purchases violates our terms of service.
1. Applicants must provide a valid business license (if applicable), Tax ID number, contact person details, and comprehensive business information for consideration.
2. Participants are required to make at least one purchase per quarter to maintain their entitlement to a 20% discount.
a. Quarters are defined as follows: January 1st to March 31st, April 1st to June 30th, July 1st to September 30th, and October 1st to December 31st.
Trade Advantage Terms of Service
1. Discounts and Exclusions: Trade Advantage members will receive a 20% discount on products, subject to manufacturer restrictions as outlined on our website. Custom Orders are not eligible for discounts.
2. Pay By Check: Any order can be paid by check for an additional 3% discount. Contact your Account Manager for a quote PRIOR to placing your order.
3. Returns/Exchanges: Trade Advantage members are not eligible for order returns. Exchanges for in-store credit may be facilitated within 30 days of the order shipping. Exchanges within 30 days do not incur a restocking fee.
4. Use of Discount Codes: Trade Advantage members are not permitted to use additional discount codes alongside their orders, unless explicitly approved by Antique Hardware Supply.
5. Discount Application: Trade Advantage members must ensure they are logged into their accounts before placing an order to receive the applicable discount. Custom orders are not eligible for discounts.
6.Shipping Fees: Trade Advantage members receive free shipping on standard shipping for orders of $50 or more in the continental US. Expedited shipping services or international shipping will incur additional shipping fees.
7. Company Information: By joining the Trade Advantage Network, all members hereby agree to be listed on our company designer & contractor page.
8. Large Orders: Orders over $2500 can be placed through our website and held on a valid credit card, but payment must be made through check, money order, or bill pay.
9. International Orders: International members of the trade can receive a 20% discount if they meet the following requirements:
a. Provide appropriate documentation of business
b. Purchase a minimum of $2000
c. Pay with money order or check
Discount Adjustment Procedure:
1. Failure to Make a Purchase Within a Quarter: If a member does not make a purchase within a quarter, their discount will automatically reduce to 10% until a purchase is made. Once a purchase is made, the discount will revert to 20% in the following quarter.
2. Consecutive Quarter Non-Compliance: If a member misses more than one consecutive quarter without a purchase, their discount drops to 5% and the free shipping rate is lost. To regain the 20% discount, they must spend at least $750 in a single quarter before the discount is returned.
